The Duke Case: Farce of Justice, Lessons Learned and Reparations

Question

Stop the deception of justice in the Duke case

1. What could have been done to prevent this farcical justice?
2. Who should be held civilly responsible for the man wrongfully accused in this case and what should be the reparations?
The Duke case was reported in 2006, when three Duke University male students were falsely arrested on suspicion of rape by a black stripper. However, the charges against the boys were dropped in 2007, and prosecutors dropped the charges for tampering with evidence (DeMets et al., 2017). This essay aims to shed light on the Duke case.

Both police and prosecutors manipulated evidence. If the judges of the court had been directly involved in the case, its proceedings, and the evidence presented to them, the evidence farce could have been prevented. DNA tests should have been checked to prevent the harassment the boys were subjected to during persecution. Police should also have been closely monitored to ensure they did not violate guidelines imposed by judicial authorities. Additionally, DNA testing should be conducted in front of juries and judges to increase the credibility of evidence and prevent evidence tampering. The judge should have been tougher to prevent Mangum from changing his story. The case could have been closed sooner because CCTV should have been checked by the judge during the trial. To avoid further judicial confusion, the court should have investigated whether both the convict and the victim were involved in previous criminal activity. Therefore, the above measures may have prevented judicial farce.

Courts, victims, and prosecutors should be held accountable for falsely accusing a boy of raping a black woman (McCannon & Wilson 2020). Boys should not only be compensated financially, but also compensated for the respect they have lost throughout their careers. They should be given more time to work on the research they missed as a result of taking the trail. All allegations should be withdrawn and the media should spread the message that the boys are not responsible for the rape because it did not occur. This will remove any suspicions people may still have. In addition, each defendant should receive $800 from law enforcement agencies as compensation for lost time and education. They should also receive grants to help them move forward in life and forget the trajectory of their trauma. They should also be offered stable jobs, since although they were acquitted of the charges, no reputable organization would hire them after the incident. The court will also have to repay the legal costs incurred to prove her innocence. In conclusion, therefore, it must be stated that it is the court’s responsibility to recognize and identify the gaps identified in the process. Courts where people wrongly accuse should also recognize the need to compensate individuals and seek to right their wrongs, while people respect them and demand justice.
